1. Agreement to Terms

By accessing or using hejGuide, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this service.

2. Description of Service

hejGuide provides a web-based platform for vacation rental hosts to manage their properties and provide a digital guest experience. The service includes:

  • Property and booking management
  • Calendar synchronization
  • Digital guidebook creation
  • Online guest check-in
  • Guest messaging and communication
  • Housekeeping and task management
  • Products and upsells
  • Reports and analytics

3. User Accounts

To use certain features of our service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept all responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. Plans and Pricing

hejGuide offers a free plan with limited functionality and paid plans with additional features:

  • The free plan includes 1 listing with core features — no credit card required
  • Paid plans (Starter, Basic, Pro, Enterprise) offer additional listings, modules, and capabilities
  • Current pricing is listed on our website at hejguide.com
  • All prices are in EUR and exclude VAT unless stated otherwise
  • We reserve the right to modify pricing with 30 days' notice to existing subscribers

5. Payment Terms

  • Paid subscriptions are charged monthly or yearly in advance via our payment provider Mollie
  • We accept iDEAL, credit cards (Visa, Mastercard, Amex), SEPA direct debit, and other methods supported by Mollie
  • Invoices are generated automatically for each payment and available in your account settings
  • You may cancel your subscription at any time — access continues until the end of the current billing period
  • Failure to pay may result in downgrade to the free plan after a 7-day grace period

6. Free Trial

Paid plans include a 14-day free trial. During the trial:

  • You have full access to all features of the selected plan
  • No payment is charged until the trial period ends
  • You may cancel at any time during the trial — no charges will be made
  • If you do not cancel, your subscription begins automatically at the end of the trial

7. Right of Withdrawal (Herroepingsrecht)

In accordance with EU consumer protection law (Directive 2011/83/EU) and Dutch law (Wet Koop op Afstand), you have the right to withdraw from a paid subscription within 14 days of your initial purchase, without giving any reason.

To exercise this right, contact us at billing@hejguide.com with your account details and a clear statement of your wish to withdraw. We will process your refund within 14 days using the same payment method as the original transaction.

Exception: By starting your subscription and actively using the paid service during the withdrawal period, you expressly consent to the immediate performance of the digital service. You acknowledge that you lose your right of withdrawal once the service has been fully performed. For partial use during the withdrawal period, you may be charged a proportional amount for the period of service used.

Renewal payments: The right of withdrawal applies to the first payment only. Recurring subscription payments are non-refundable but can be cancelled at any time (see Section 8).

8. Cancellation and Refunds

  • Cancel anytime: You may cancel your subscription at any time through your account settings or by contacting us. No cancellation fees apply.
  • Access after cancellation: You retain access to paid features until the end of your current billing period. After that, your account is downgraded to the free plan.
  • Data retention: Your data is preserved for 30 days after downgrade. You can export your data at any time (see our Privacy Policy).
  • Refunds for service issues: If the service was materially unavailable or defective during a billing period, you may request a proportional refund by contacting billing@hejguide.com.
  • Annual subscriptions: If you cancel an annual subscription, access continues until the end of the prepaid year. No partial refunds are provided for unused months, except within the 14-day withdrawal period.

9. Acceptable Use

You agree not to use hejGuide to:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit harmful, offensive, or illegal content
  • Interfere with or disrupt the service
  • Attempt to gain unauthorized access to any portion of the service
  • Use the service for any commercial purpose other than hosting your own properties

10. Content Ownership

You retain all rights to the content you create and upload to hejGuide. By using our service, you grant us a license to:

  • Host and display your content as part of the service
  • Make backups of your content for data protection
  • Use anonymized data for analytics and service improvement

11. Intellectual Property

The hejGuide service, including its original content, features, and functionality, is owned by hejGuide and is protected by international copyright, trademark, and other intellectual property laws.

12. Service Availability

We strive to provide 99.9% uptime but do not guarantee uninterrupted access to the service. We reserve the right to:

  • Perform scheduled maintenance with advance notice
  • Suspend service for emergency maintenance
  • Modify or discontinue features at any time

13. Limitation of Liability

To the maximum extent permitted by law, hejGuide shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service.

14. Indemnification

You agree to indemnify and hold harmless hejGuide from any claims, damages, losses, liabilities, and expenses arising from your use of the service or violation of these Terms.

15. Termination

We may terminate or suspend your account and access to the service immediately, without prior notice, for conduct that we believe:

  • Violates these Terms of Service
  • Is harmful to other users or the service
  • Exposes us to legal liability

16. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes by email or through the service. Continued use of the service after changes constitutes acceptance of the new terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
